LOU WATERS, CNN ANCHOR: We have, in just the passed few minutes, gotten a bit of news out of San Francisco regarding Theodore Kaczynski. You may know the name; the media had dubbed him the Unabomber after a 20 year bombing spree that killed three people and injured 23 but in 1998. Kaczynski pleaded guilty to avoid the death penalty, in exchange for that guilty plea, he received a life sentence, but subsequent to that, he has been making a bid to the federal appeals court in San Francisco, the Ninth Circuit -- asking for a trial. He claims a federal judge in Sacramento overseeing his case violating his rights by allowing his lawyers to use his mental condition as a defense under the original plea bargain. Now, the Ninth Circuit has just ruled on that. They voted 2-1 to deny Theodore Kaczynski a trial. Kaczynski had said that he wanted a trial, even if it meant the death penalty.
